The Unseen Drama LLP (‘The Unseen’, ‘we’) is committed to protecting the privacy and security of any personal data provided to us by students and others, including users of our website.  

This Privacy Policy (‘Policy’) outlines how we collect, use, store, and share the information we gather through our website and various courses and gives further information about your data protection rights as a website user or student or prospective student.

 

 

1. Grounds for data collection

Processing of your personal data (meaning, any information which may potentially allow your identification with reasonable means) is necessary for the performance of our contractual obligations towards you and providing you with our courses and other services, to protect our legitimate interests and for compliance with legal, accounting and financial regulatory obligations to which we are subject.

When you use our website, you consent to the collection, storage, use, disclosure and other uses of your personal data as described in this Policy.

We encourage our students and website visitors to carefully read this Policy and use it to make informed decisions.

 

 

2. What information we collect?

We collect two types of data and information from students: 

The first type of information is un-identified and non-identifiable information pertaining to a website visitor, which may be made available or gathered via your use of our website (‘non-personal data’). This non-personal data is collected using Google Ads Cookies.

These cookies, and other essential cookies that help our website function, do not contain any information that personally identifies you, but personal data that we store about you could be linked, by us, to the information stored in and obtained from cookies. You may remove the cookies by following the instructions of your device preferences; however, if you choose to disable cookies, some features of our website may not operate properly and your online experience may be limited.

We use Google Ads cookies on our website for conversion tracking purposes. These cookies help us understand how visitors interact with our advertisements and website. By continuing to use our website, you consent to our use of these cookies, however note that you may have the option of activating and de-activating (as the case may be) cookies through your browser.

We are not aware of the identity of a website visitor from which non-personal data is collected. Non-personal data which is being collected may include your aggregated usage information and technical information transmitted by your device, including certain software and hardware information (e.g. the type of browser and operating system your device uses, language preference, access time, etc.) in order to enhance the functionality of our website. We may also collect information on your activity on the website (e.g. pages viewed, online browsing, clicks, actions, etc.).

The second type of information is personal data, which is individually identifiable information, namely information that identifies an individual or may with reasonable effort identify an individual. Such information will take the form of enquiry and registration information, which you voluntarily supply to us.

 

The only personal information we collect directly from our students are their names and e-mail addresses, which occurs when prospective students e-mail us to enquire about availability of courses or sign up for courses. 

Names provided by students are then used for sign-in verification at our events and are stored securely in a Google Docs spreadsheet.

 

 

3. Use, Storage and Deletion of Information

We do not rent, sell, or share personal data with third parties except as described in this Policy and set out below.

3.1. Personal data in general:

Names collected for sign-in purposes are held in a Google Docs spreadsheet and are automatically deleted either:

(i). two (2) weeks after the completion of the classes students attend, unless a student books another course; or, 

(ii). immediately after we decide that it is no longer necessary that we hold your personal data, to provide our services, and as necessary to comply with our legal obligations, resolve disputes, and enforce our policies.

In general, retention periods will be determined by taking into account the type of information that is collected and the purpose for which it is collected, bearing in mind the requirements applicable to the situation and the need to destroy outdated, unused information at the earliest reasonable time. Under applicable regulations, we will keep records containing client personal data, account opening documents, communications and anything else as required by applicable laws and regulations. 

We may rectify, replenish or remove incomplete or inaccurate information, at any time and at our own discretion.

3.2. Showcase Videos and Feedback:

Students who participate in our online showcase submit to us a short video of their own performance by uploading it to a designated secure account on a social media platform or other portal or platform (‘the Showcase Account’).   

We provide written feedback on the uploaded showcase. Feedback documents are deleted from the records of The Unseen after twelve (12) months.

Students acknowledge and agree that:

(i). by voluntarily uploading their showcase video, they are agreeing that The Unseen may indefinitely share the video with third parties in the industry who may be interested in employing or engaging the student;

(ii). this will involve a transfer of the student’s personal data to a third party outside The Unseen, to which the student consents; 

(iii). The Unseen has no control over what is done with the showcase video once it is in the hands of third parties;;

(iv). since the video may identify the student, third parties may contact the student directly without reference to The Unseen.

Students may request the removal of their video at any time from the Showcase Account, in which case The Unseen will not continue to share that video with third parties from that point. 

3.3. WhatsApp Groups:

We use WhatsApp groups to disseminate information to students. Please be aware that phone numbers are visible to other members within these groups due to the nature of the technology. Privacy terms for use of Whatsapp are governed by Whatsapp.  Students can join or leave the group at any time.

3.4. Information Sharing:

We may disclose your personal data if in good faith we believe that disclosure of such information is helpful or reasonably necessary to: (i) comply with any applicable law, regulation, legal process or governmental request; (ii) enforce our policies (including our Terms and Conditions and this Policy), including investigations of potential breaches thereof; (iii) investigate, detect, prevent, or take action regarding illegal activities or other wrongdoing, suspected fraud or security issues; (iv) to establish or exercise our rights to defend against legal claims; (v) prevent harm to the rights, property or safety of us, our users, yourself or any third party; or, (vi) for the purpose of collaborating with law enforcement agencies and/or in case we find it necessary in order to enforce intellectual property or other legal rights.

3.5. Google and Whatsapp LLC as sub-processors

You acknowledge and consent that for the purposes of providing our services to you, The Unseen is a data controller and Google LLC, Whatsapp LLC and other third party service providers, as the case may be, are data sub-processors, such meaning been given to them under the Data Protection Act 1988.

4. Your Rights

You may request to: 

  • Receive confirmation as to whether or not personal data concerning you is being processed, and access your stored personal data, together with supplementary information. 
  • Receive a copy of personal data you directly volunteer to us in a structured, commonly used and machine-readable format. 
  • Request rectification of your personal data that is in our control.
  • Request erasure of your personal data. 
  • Object to the processing of personal data by us. 
  • Request to restrict processing of your personal data by us.
  • Lodge a complaint with a supervisory authority.

However, please note that these rights are not absolute, and may be subject to our own legitimate interests and regulatory requirements.

5. Third party collection of information

Our policy only addresses the use and disclosure of information we collect from you. To the extent you disclose your information to other parties or websites throughout the internet or by using our services (including the Whatsapp and showcase services referred to above), different rules may apply to their use or disclosure of the information you disclose to them. Accordingly, we encourage you to read the terms and conditions and privacy policy of each third party that you choose to disclose information to. 

This Policy does not apply to the practices of companies that we do not own or control, or to individuals whom we do not employ or manage, including any of the third parties which we may disclose information as set forth in this Policy.

 

 

6. Security

While we take reasonable technical and organisational measures to protect the personal data we collect against loss, theft, misuse, and unauthorised access, disclosure, alteration, and destruction, we cannot be responsible for the acts of those who gain unauthorised access or abuse our website, and we make no warranty, express, implied or otherwise, that we will prevent such access.

Your continued use of our website and any of our services, following the notification of such amendments on our website, constitutes your acknowledgment and consent of such amendments to this Policy and your agreement to be bound by the terms of such amendments.

10. Compliance

As we are processing your personal data for core business purposes, we are not required to register with, and pay a fee to, the Information Commissioner’s Office.
